Lululemon?s pricey and popular fitness apparel has captured the imagination of devotees, along with competitors seeking a slice of the company?s market share. But the yoga-wear powerhouse has been far from zen about protecting its turf and has been actively patenting its distinctive designs.

Now the Canadian company is striking a warrior pose, suing fashion design firm Calvin Klein Inc. and manufacturer G-III Apparel Group Ltd. over allegations that Calvin Klein infringed Lululemon?s design patents related to the waistband of its signature $98 Astro Pant.

?They?re trying to turn their innovative designs into a competitive advantage, and they?re using legal protections to do that,? says University of Ottawa law professor Jeremy de Beer. ?It remains to be seen if the strategy is going to be effective. At the very least it?s going to give competitors second thoughts because it may not be worth the legal headache.?

Lululemon has cornered a fashion niche with a low barrier to entry. As a result, the company is investing in legal capital to retain its position at the top of the market. Design patent litigation is not a common move in the fashion industry, but it is part of a broader trend where designers are seeking creative ways to protect their intellectual property rights. Some experts argue that these sorts of claims are not in the best interest of fashion?or the true intent of the law.

De Beer worries designers could ?stockpile? patents to use as a threat and deterrent with no intent to actually litigate, ?like some kind of intellectual property cold war.?

But design patents aren?t within reach of your average entrepreneur. They are intended to cover ornamental, nonfunctional aspects of an item, which must be new, nonutilitarian and nonobvious. Design patents are expensive, time-consuming and potentially not worth the cost, particularly for seasonal items, experts say.

?The problem is you can?t go out and patent everything,? says Harley Lewin, a partner at McCarter & English in Manhattan whose clients include Christian Louboutin, Alexander Wang and Diane von Furstenberg. ?You have a delay and ? you have to remember a design patent is a very literal interpretation, and someone has to copy you pretty exactly. The likelihood of losing is high. It?s mostly used as a deterrent.?

Susan Scafidi, founder of Fordham University?s Fashion Law Institute, agrees, noting that Lululemon?s complaint is as much about public relations as it is about the infringement case itself.

?One small step for yoga pants, one large step for a company,? Scafidi says. ?They are using the [design patent] procedure to aggressively enforce any infringement. It?s a PR move as well, sending a warning message to other companies and to their fans: The other guys are just not playing in the same design league.?

Lululemon does not appear to be letting its guard down as low-end and high-fashion manufacturers alike circle its territory. Not coincidentally, since the lawsuit was filed, the Calvin Klein Performance Pants at issue have disappeared from store shelves and its website.

North Korea detains a U.S. citizen for unspecified 'crimes'

PYONGYANG, North Korea - North Korea said Friday that it has detained an American citizen who has confessed to unspecified crimes.

State media said in a short dispatch that someone named Bae Jun Ho entered North Korea on Nov. 3 as a tourist but was detained because of crimes.

The North said the crimes were "proven through evidence" but didn't elaborate.

Pyongyang has detained and eventually released several Americans in recent years. Some have been Christians accused of religious proselytizing.

Two journalists were also detained after crossing into the North from China while on a reporting trip but were later released.

South Korean activists have told local media in Seoul that Bae is a Korean American and was detained after entering North Korea to guide tourists. Bae operates a tourism company that specializes in North Korea, the reports said.

The North Korean dispatch said officials from the Swiss Embassy met Bae on Friday, but there were no other details about the meeting. The United States doesn't have diplomatic relations with Pyongyang so American citizens are given aid by the Swiss.

Bae is undergoing "legal treatment" according to North Korea's criminal law, the North's official Korean Central News Agency said.

Exclusive survey: California Democrats agree to ban assault weapons, Republicans mostly silent

Democrats representing California in Congress are promising to push for new gun control measures in the aftermath of the horrific slayings at a Connecticut elementary school last week, but the state's Republicans representatives were mostly silent amid the renewed debate over firearms legislation.

An exclusive survey of all 53 California House members and members-elect, by the Los Angeles News Group and Bay Area News Group, found all 32 of the 38 Democrats who responded to the survey support re-enacting some version of the federal assault weapons ban that existed from 1994 to 2004.

Many would consider even more stringent gun controls and said some popular firearms, such as the .223-caliber AR-15, are "weapons of war" that are unfit for civilian use.

"Reinstating and improving the Assault Weapons Ban should be one of the first issues Congress takes up next year," said Rep. Adam Schiff, D-Glendale.

Gun control has moved to the forefront of political debate following Friday's massacre at Sandy Hook Elementary School in Newtown, Conn.

There, Adam Lanza shot and killed 20 children and six adults before committing suicide.

Lanza is reported to have used a Bushmaster AR-15 during the rampage. Authorities said Saturday that Lanza's victims at the school had all been shot at close range with the rifle.

Previously, Lanza was said to have used Glock and Sig-Sauer handguns. He is also reported to have stolen the guns

from his mother before shooting her to death and then beginning his killings at the school.

"Before the horrific shooting in Newtown, I was involved in conversations about putting in place common-sense regulations like the Assault Weapons Ban, closing the gun-show loophole and outlawing extended ammunition clips," said Schiff, who is a former federal prosecutor.

The near-total silence from California's GOP delegation, however, perhaps illustrates the deep partisan divide Congress will experience during the impending debate.

Only one of California's 15 GOP House members specifically answered the four questions posed by the newspapers: Rep. Tom McClintock, R-Granite Bay, who took a stand against increased gun control.

"Such laws tend to create a society in which criminals are as well-armed as ever and law-abiding citizens are rendered increasingly defenseless," McClintock said.

Citizens have a constitutional right to defend themselves with firearms, he said, and the Bushmaster rifle might look like a military assault weapon "but functions with the same firing mechanism as many handguns, sports and target rifles."

Other California Republicans were less willing to offer their opinions.

California Attorney General Kamala D. Harris announced on Tuesday, Dec. 18, 2012 that 2,000 firearms were seized from individuals legally barred from possessing them, including persons determined to be mentally unstable and those with active restraining orders.

Rep. Ken Calvert, R-Corona, and Rep. Gary Miller, R-Brea, declined to discuss gun-control issues until after a full investigation of the Connecticut rampage is done.

Rep.-elect Doug LaMalfa, R-Oroville, said "restricting the rights of those who follow the law will only empower those who choose to break the law," but he wouldn't answer specific questions.

All other Republicans either were said to be unavailable for comment, or never responded to calls and emails.

Rep. Zoe Lofgren, chairwoman of the California Democratic Congressional Delegation, said her members stand ready to act.

"If Republicans want to change, we'll work with them," said Lofgren, D-San Jose, noting other mass shootings "didn't seem to move the dial on the other side of the aisle. I hope that something this appalling might stir my colleagues to action."

There was more backlash from the Newtown shootings on Tuesday.

? President Obama said he would support reinstatement of the federal assault weapons ban.

? Private equity firm Cerberus, in which the California State Teachers' Retirement System is an investor, said it will sell the parent company that makes the Bushmaster gun used in the attack.

? Dick's Sporting Goods, with more than 500 stores in 44 states, said it's suspending sales of modern sporting rifles.

Bushmaster .223 and similar semi-automatic firearms that resemble military weapons.

Commercially available AR-15s cannot fire multiple rounds with a single trigger pull. They can, however, fire the same .223 cartridges used by the military.

No California Democrat said Americans have a constitutional right to a weapon such as the AR-15 nor extended magazines.

"Weapons of war are not intended for hunting or protecting your family," Rep.-elect Gloria Negrete-McLeod said in an emailed statement. "This ban prevents extremely deadly guns used for war to be sold or distributed within the civilian population."

McLeod will represent a congressional district that includes parts of eastern Los Angeles County and the western Inland Empire.

She won her seat in November by defeating veteran Rep. Joe Baca, a fellow Democrat who holds liberal views on social services on immigration but also has a pro-gun ownership reputation.

McLeod, however, received more than $5.2 million in outside spending support from Independence USA, the super PAC of pro-gun control New York City Mayor Michael Bloomberg.

Baca had a 75 percent favorable rating from the National Rifle Association, compared to McLeod's 17 percent.

California's senior senator, Democrat Dianne Feinstein, has already pledged to introduce legislation that would stop the manufacture and sale of more than 100 specific firearms plus others that have certain features.

Feinstein's bill would also prohibit magazines that can hold more than 10 rounds and grandfather weapons that are now legal.

Congressional Republicans have opposed all efforts to reinstate a federal assault weapons ban since the 1994 law that Bill Clinton signed expired in 2004.

A 2004 National Institute of Justice study reported the previous Assault Weapons Ban had mixed results in reducing gun crimes.

The law prohibited 118 weapons and large-capacity magazines carrying more than 10 rounds. Assault weapons, however, were only used in 2 percent to 8 percent of gun crimes prior to the ban.

Assault rifles and other guns equipped with large magazines accounted for a higher share of murders of police officers and mass public shootings, incidents the 2004 study described as rare.

The report also found the availability of pre-ban large capacity magazines made it easy for criminals to obtain them.

"Should it be renewed, the ban's effects on gun violence are likely to be small at best and perhaps too small for reliable measurement," the 2004 report reads.

The newspapers' survey taken this week found Democrats gave mixed reviews to the idea of requiring background checks, including mental-health screening, for all members of a household where guns are kept.

Checking a purchasers' household may be too difficult to enforce, one said.

"It just raises questions, who lives there, who doesn't, who moves into the home," said Rep.-elect Alan Lowenthal of Long Beach.

Many Democrats, however, were willing to discuss the idea of requiring gun owners to take courses, get licenses and register all firearms similar to what states already require for cars.

Gun rights advocates said they were not completely ready to debate gun laws.

Chuck Michel, civil-rights attorney for the California Rifle and Pistol Association Foundation, said this isn't the right time.

"Politicians pushing legislative wish lists so soon after the slayings are shameless opportunists taking advantage of an emotionally charged situation to advance a pre-existing agenda," he said.

The National Rifle Association said in a statement issued Tuesday it's "shocked, saddened and heartbroken" by the Newtown slayings and is "prepared to offer meaningful contributions to help make sure this never happens again."

The NRA wields significant influence on Capitol Hill. The Sunlight Foundation - a nonprofit, nonpartisan government transparency watchdog - reports the NRA spent 73 times what the leading pro-gun control advocacy organization, the Brady Campaign to Prevent Gun Violence, spent on lobbying in the 112th Congress.

Through June, the NRA spent $4.4 million on lobbying expenses to the Brady Campaign's $60,000.

What's more, the NRA spent 3,199 times what the Brady Campaign spent on the 2012 election - $18.6 million to $5,816.

Public opinion, however, has tilted in favor of gun control, at least in the days since the Newtown shooting.

A CBS News poll in April found 39 percent of adults nationwide believed gun control laws should be made more strict, 13 percent said they should be made less strict and 41 percent said they should be kept as they are.

A new poll conducted Friday through Sunday found 57 percent now want stricter laws, 9 percent want less strict laws, and 30 percent say the laws should be kept as they are.

Afghanistan Village Massacre: Army Will Seek Death Penalty For ...

SEATTLE -- The U.S. Army said Wednesday it will seek the death penalty against the soldier accused of killing 16 Afghan villagers in a predawn rampage in March, a decision his lawyer called "totally irresponsible."

The announcement followed a pretrial hearing last month for Staff Sgt. Robert Bales, 39, who faces premeditated murder and other charges in the attack on two villages in southern Afghanistan.

The slayings drew such angry protests that the U.S. temporarily halted combat operations in Afghanistan, and it was three weeks before American investigators could reach the crime scenes.

Prosecutors said Bales left his remote southern Afghanistan base early on March 11, attacked one village and returned to the base, then slipped away again to attack another nearby compound. Of the 16 people killed, nine were children.

No date has been set for Bales' court martial, which will be held at Joint Base Lewis-McChord south of Seattle.

His civilian lawyer, John Henry Browne, told The Associated Press he met with Army officials last week to argue his client shouldn't face the possibility of the death penalty, given that Bales was serving his fourth deployment in a war zone when the killings occurred.

"The Army is not taking responsibility for Sgt. Bales and other soldiers that the Army knowingly sends into combat situations with diagnosed PTSD, concussive head injuries and other injuries," Browne said. "The Army is trying to take the focus off the failure of its decisions, and the failure of the war itself, and making Sgt. Bales out to be a rogue soldier."

Bales' wife, Kari Bales, said in a statement Wednesday that she and their children have been enjoying their weekend visits with Bales at Joint Base Lewis-McChord, and she hopes he receives an impartial trial.

"I no longer know if a fair trial for Bob is possible, but it very much is my hope, and I will have faith," she said.

Bales' defense team has said the government's case is incomplete, and outside experts have said a key issue going forward will be to determine if Bales suffered from post-traumatic stress disorder. Bales grew up in the Cincinnati suburb of Norwood, Ohio, and served tours of duty in Iraq and Afghanistan.

During last month's preliminary hearing, prosecutors built a strong eyewitness case against the veteran soldier, with troops recounting how they saw Bales return to the base alone, covered in blood. One soldier testified that Bales woke him up in the middle of the night, saying he had just shot people at one village and that he was heading out again to attack another. The soldier said he didn't believe Bales and went back to sleep.

Afghan witnesses questioned via a video link from a forward operating base near Kandahar City described the horror of that night. A teenage boy recalled how the gunman kept firing as children scrambled, yelling: "We are children! We are children!" A young girl in a bright headscarf recalled hiding behind her father as he was shot to death.

An Army criminal investigations command special agent testified earlier that Bales tested positive for steroids three days after the killings, and other soldiers testified that Bales had been drinking the evening of the massacre.

Prosecutors, in asking for a court-martial trial, have pointed to statements Bales made after he was apprehended, saying his comments demonstrated a "clear memory of what he had done, and consciousness of wrongdoing."

Several soldiers testified at a hearing that Bales returned to the base alone just before dawn, covered in blood, and that he made incriminating statements such as, "I thought I was doing the right thing."

The U.S. military has not executed anyone since 1961. There are five men currently facing military death sentences, but none for killings committed in war zones, according to the Death Penalty Information Center. Nidal Hasan, charged in the 2009 rampage that killed 13 and wounded more than two dozen others at Fort Hood in Texas, also could face the death penalty if convicted; no date has been set for his court martial.

Elizabeth Hillman, president of the National Institute of Military Justice, said Bales' mental health and its impact on culpability will undoubtedly play a central role in his court-martial.

In an email to the AP, she said that on one hand, the Army's decision to seek the death penalty is surprising, given that the killings took place in a war zone.

"But on the other hand, it's not surprising that the Army wants to make a statement about the critical need to protect against unnecessary civilian deaths in wartime," she wrote.

For Bales to face execution, the court martial jury must unanimously find him guilty of premeditated murder. They also must determine that at least one aggravating factor applies, such as multiple or child victims, and that the aggravating factor substantially outweighs any extenuating or mitigating circumstances.

NBA power rankings 2012: Heat among elite teams

The Miami Heat are in the top ten of all the major NBA power rankings. Where do they rank specifically and what do basketball writers have to say about them?

The Miami Heat find themselves among the best teams in the NBA. Power rankings compilers have the Heat near the top of the lists. Seth Rosenthal has the Heat ranked No. 5 in the SB Nation NBA power rankings and ESPN's John Hollinger has the Heat ranked at No. 6, unchanged from the previous week.

Marc Stein has the Heat rising one spot in his power rankings to No. 5. Stein has nothing but questions for the Heat, but also brings up the fact that despite a recent loss to the Washington Wizards, the Heat haven't lost that much against teams they shouldn't lose to:

Did the Heat get a free pass from media pests like me after the Washington loss because we're all so consumed with the Lakers' chaos? Does a 30-point weekend rout of the Wiz atone for that no-show? Do you realize Miami's other five losses were all inflicted by teams in our top seven?

However, not all power rankings lists are high on the Heat. Matt Moore, who does the NBA power rankings for CBSSports.com has the Heat ranked at No. 7, down three spots from last week. The only thing he has to say about them is just to wait for April for them to start getting hot:

Might as well change their name to the Miami Yawn until April.

Kurt Helin of Pro Basketball Talk is not as critical of the Heat, having them rise two spots to No. 4 in his power rankings. Helin believes that their home scheduling should work in their favor through Christmas:

They are 11-2 at home (with a home-heavy early schedule) and three of their next four are at home, ending with a Christmas Day finals rematch with the Thunder. Then they head out on the road where they are a .500 team.

As for the Orlando Magic, they are ranked No. 21 in the SB Nation power rankings and ranked No. 17 in Hollinger's power rankings. The Magic are also ranked No. 19, up two spots from last week, in Stein's power rankings. Stein believes that the Magic should be getting some more attention for how they are playing lately:

Thermal imaging inconclusive in Texas DPS shooting

AUSTIN, Texas (AP) ? A thermal imaging device aboard a Texas Department of Public Safety helicopter was inconclusive before an airborne trooper opened fire on a truck, killing two Guatemalan immigrants.

DPS spokesman Tom Vinger on Monday told the Austin American-Statesman (http://bit.ly/U8t0UB ) that the image in the October shooting in Hidalgo County was not distinguishable. Such devices can detect body heat.

A 14-year-old driver remains in custody after the incident near the Texas-Mexico border ended with a trooper shooting into the blanket-covered back of the fleeing vehicle. DPS has said the helicopter crew believed the truck was hauling drugs.

No drugs were found. Nine Guatemalan immigrants allegedly were being smuggled and six were in the truck bed.

Texas Rangers are investigating. DPS director Steve McCraw has asked the Justice Department for an independent investigation.

Hobbit Houses: Dwellings Right at Home in ... - AOL Real Estate


While you have to go to the theater to see "The Hobbit," some people experience J.R.R. Tolkien's Middle Earth every day. The books that inspired the new movie and the "Lord of the Rings" film trilogy have also inspired home design for years. Among the most recent dwellings is one built for a diehard Tolkien fan in Chester County, Pa.: a 600-square-foot guesthouse with a cartoonishly curved roof and a 54-inch circular cedar door.

Inside are wood arches, a "butterfly window," a stucco fireplace -- and walls of shelves where its owner displays a vast collection of Tolkien memorabilia acquired over 30 years. The whimsical home was built with stones from a collapsed 18th-century wall in the owner's yard.

"This isn't something that you can re-create on a suburban cul-de-sac," Peter Archer, the architect behind the fantastical house, told The Associated Press. "It was made for this specific location, and it wouldn't work anywhere else."

Japanese Companies Turn to Real Estate to Improve Cashflow ...

Cash-strapped Japanese companies have recently turned to real estate to cut costs and improve cash-flow. Panasonic Corp., Sony Corp., and Sharp Corp., are selling buildings and businesses in what is considered a huge garage sale, that could raise $3 billion combined.

Hideaki Kawai, Panasonic?s chief financial offer said that the company plans to raise $1.34 billion from offloading property and shares in other companies in Japan by the end of March. Kawai added that the company will sell more assets in the year beginning April if cashflow decreases below 200 billion yen.

Meanwhile, fixed assets of Sony, Panasonic and Sharp totaled around $42 billion while their combined market value is $24 billion. Analysts say that these companies have been downgraded by credit rating agencies, which made it more difficult to raise money on capital markets, and made asset sales more urgent.

According to Alvin Lim, an analyst at Fitch Ratings in Seoul, the companies? decision to sell assets is a good one, in terms of their credit ratings. It will lower fixed costs and help the companies reduce capex requirements and will eventually help improve operating margins and cashflow.

Panasonic plans to give more focus on its batteries and auto parts business while Sony is doubling down on mobile, gaming and cameras. Sharp also announced that they will focus on display screens, even looking to work with Hon Hai Precision Industry and Qualcomm Inc.

Sony has already made its move to real estate, to raise money. The company is looking at possible sale of its 37-story headquarters in New York City, which when sold, could raise $1 billion. Sharp, which plans to work with Qualcomm has already started well; Qualcomm has agreed to buy 5% stake in Sharp. While Hon Hai agreed to buy shares, the company didn?t give details about how much the company is willing to take. This being a critical step, Lim adds that the big three should take whatever they can get so that they can get back on their feet through this fiscal period to remain afloat in the market.

Mysticism, Internet fuel Mexico's Maya "Armageddon" fears

CHICHEN ITZA, Mexico (Reuters) - A few words by an American scholar, a crumbling Mexican monument and the love of a good yarn were all it took to spawn the belief that the world could end this week.

December 21 marks the end of an age in a 5,125 year-old Maya calendar, an event that is variously interpreted as the end of days, the start of a new era or just a good excuse for a party.

Thousands of New Age mystics, spiritual adventurers and canny businessmen are converging on ancient ruins in southern Mexico and Guatemala to find out what will happen.

"No one knows what it will look like on the other side," said Michael DiMartino, 46, a long-haired American who is organizing one of the biggest December 21 celebrations at the Maya temple site of Chichen Itza on the Yucatan peninsula.

It is not the world but "the way we perceive it" that will end, said DiMartino, who pledged his event at ground zero for 2012 acolytes will be a "distilling down of various perspectives into a unified intention for positive transformation, evolution and co-creation of a new way of being."

A mash-up of academic speculation and existential angst seasoned with elements from several world religions, the 2012 phenomenon has been fueled by Hollywood movies and computer games, and relentlessly disseminated by Internet doom-mongers.

Mass hysteria in a Russian prison, a Chinese man building survival pods for doomsday and UFO lovers seeking refuge with aliens in a French mountain village are just some of the reports that have sprung up in the final countdown to December 21.

Robert Bast, a New Zealander living in Melbourne who wrote a book called "Survive 2012" on how to cope with the possible catastrophe, believes the Maya may have sent out a warning.

"The most likely thing for me is a solar storm, but that's not going to kill you straight away. It's more of a long term disaster," said Bast, 47, noting a flu pandemic could also strike the planet. "I feel the world isn't as safe as we think it is. The last couple of generations have had it very cozy."

When dawn breaks on Friday, according to the Maya Long Count calendar, it marks the end of the 13th bak'tun - an epoch lasting some 400 years - and the beginning of the 14th.

This fact would probably have languished in academic obscurity had not a young Maya expert named Michael Coe written in the 1960s that to the ancient Mesoamerican culture the date could herald an "Armageddon" to cleanse humanity.

Since then, the cult of 2012 has snowballed.

Among the sun-bleached pyramids, shaded mangroves and deep cenotes of the Maya heartland, there are hopes December 21 will bring a spiritual re-birth.

Nobody seems quite sure what to expect on Friday, but it has not stopped people getting their hopes up.

"This is the Arab Spring of the spiritual movement," said Geoffrey Ocean Dreyer, a 52-year-old U.S. musician wearing a sombrero and mardi gras beads. "We're going to create world peace. We're going to Jerusalem and we're going to rebuild Solomon's temple."

ANXIETY ATTACKS

The words of Coe, a highly respected Maya scholar, were published in 1966 at the height of the Cold War, stirring fears in a world haunted by the prospect of nuclear holocaust.

Coe could not be reached for comment for this article, but friends and academics who know him insist he never meant to inspire a vision of apocalypse when he committed them to paper.

Stephen Houston, a Maya expert at Brown University in Rhode Island and student of Coe's, said too much has been read into the end of the 13th bak'tun, which was little more than a "dull mathematical declaration" used to bracket dates.

"I see it all as an expression of present day anxiety and not much more than that," Houston said.

Few remaining inscriptions refer to the event, and the best known one is part of a monument recovered from a Maya site in Tabasco state called Tortuguero - much of which was torn down in the 1960s to make way for the construction of a cement factory.

Still, the mix of religion, ancient inscriptions and media-driven speculation about impending doom remains potent.

"I got an email the other day from a mother who was contemplating taking her own life, because she didn't know what was really going to happen, she didn't want her children to live through this ordeal," said David Stuart, a Maya expert at the University of Texas. "We can dismiss it as a kooky idea, which it is, but they're still ideas and they still have power."

U.S. space agency NASA has sought to allay fears of impending catastrophe, noting that "our planet has been getting along just fine for more than 4 billion years, and credible scientists worldwide know of no threat associated with 2012."

Nothing has given the 2012 theories more oxygen in the run-up to the big day than the Internet, noted John Hoopes, a Maya anthropologist at the University of Kansas.

"Computers come straight out of the same people who were smoking pot and protesting at Berkeley and Stanford," he said, referring to U.S. student movements in the 1960s.

"This Maya calendar stuff has been part of hacktivism lore for 40 years, since the beginning, and with every significant change in computer technology, it's gotten another boost."

Many of those gathering in Chichen Itza praised the Internet as a discussion forum and organizing tool for New Age events.

"We don't need leaders now we have the Internet," said Muggy Burton, 66, who had traveled to Mexico from Canada with her 15-year-old, blue-haired granddaughter, Talis Hardy.

The two, who communicate with each other by whistling, plan to live in Mexico for six months, according to Burton, who is going to homeschool Hardy. "It's the end of the world for her, and the beginning of a new one," she added.

MAYA SKEPTICS

Mexico's federal government is not officially marking the phenomenon, but the country's tourism agency has launched a "Mundo Maya 2012" website with a countdown to December 21.

Up to 200,000 people are expected to descend on Chichen Itza alone for the night of December 20.

Among modern descendants of the Maya, the idea it could all come to an end on Friday generally raises a wry smile - but they are happy to play along if it makes money.

"It's a psychic epidemic," said Miguel Coral, 56, a cigar salesman in Merida, a colonial town and capital of Yucatan state. "It's all about business, but that's fine. It helps our country. I think it's excellent we've exported this idea."

Nearby, workers built a pyramid of spray-painted polystyrene blocks for the opening of the town's Maya festival.

"If people who believe in this joke want to come, let them," said Jose May, a Merida tourism official of Maya descent. "Nobody here believes that. Those people were sold an idea."

Hazy rumors have helped feed the sense of anticipation.

A few hours' drive south of Merida in the remote Maya town of Xul, which means "the end," media reports began circulating as early as 2008 that a group of Italians were readying themselves for impending doom by building apocalypse-proof bunkers.

Today, the settlement dubbed the "end of the world resort" is open for business as "Eco Spa Las Aguilas."

"There's no truth in it," said deputy manager Andrea Podesta, 45, referring to speculation it was a cult.

"Some people came here, took some hidden photos, and published some very unpleasant articles about us," he added, noting the glistening new spa was booked up well into 2013.

Inside, a group of elderly Italians, mostly dressed in white, were watching the path of an asteroid on a giant screen. A black-and-white image of Christ's face hung from the wall and a large stone statue of a robed woman greeted visitors.

Whatever lies in store for the planet, even Maya academics who have fought to play down the hype surrounding the passing of another 24 hours feel there could still be some surprises.

"I think there may be some mischief on December 21 because the whole world is watching," said Hoopes in Kansas, citing rumors hacktivist group Anonymous was planning a stunt. "It's a very fertile opportunity for a tremendous prank."

Southwest to charge passengers who don't show up

Southwest Airlines customers will soon pay a fee for not canceling a ticket before their flight.

The airline outlined the new policy Friday at an investors' conference in New York.

Right now, Southwest lets passengers who don't use their ticket apply the price toward a new ticket. Southwest says it can reduce no-shows and generate more revenue by adding the cancellation fee on restricted tickets.

Company officials said the new fee will start next year, but they didn't give an exact date or say how much the fee will be.

Southwest also plans to increase fees it already charges, such as for early check-in and overweight bags. Its AirTran Airways subsidiary will raise bag fees in February.?

In a message beginning "Dear President Obama," Great Britain?s Queen Elizabeth said, "I have been deeply shocked and saddened to learn of the dreadful loss of life today in Newtown, Connecticut; particularly the news that so many of the dead are children."

"My thoughts are with the injured and those who have lost loved ones,? British Prime Minister David Cameron said. ?It is heartbreaking to think of those who have had their children robbed from them at such a young age, when they had so much life ahead of them.?

From Germany, Chancellor Angela Merkel said: ?Once again we stand aghast at a deed that cannot be comprehended. ?The thought of the murdered pupils and teachers makes my heart heavy."

With more than 100,000 Chinese studying in US schools, a sense of shared grief came through.

"Parents with children studying in the US must be tense. School shootings happen often in the U.S. Can't politicians put away politics and prohibit gun sales?" Zhang Xin, a wealthy property developer, wrote on her feed on the Twitter-like Sina Weibo service, where she has 4.9 million followers.

In the Philippines, a society often afflicted by gun violence, President Benigno Aquino III said he and the Filipino people stand beside the United States "with bowed heads, yet in deep admiration over the manner in which the American people have reached out to comfort the afflicted, and to search for answers that will give meaning and hope to this grim event.

"We pray for healing, and that this heartbreak will never be visited on any community ever again," Aquino said in a statement tweeted by deputy presidential spokesman Abigail Valte.

In Thailand, which has one of Asia's highest rates of murder by firearms and has seen schools attacked by Islamist insurgents in its southern provinces, a columnist for the English-language daily newspaper The Nation blamed American culture for fostering a climate of violence.

"Repeated incidents of gunmen killing innocent people have shocked the Americans or us, but also made most people ignore it quickly," Thanong Khanthong wrote on Twitter. "Intentionally or not, Hollywood and video games have prepared people's mind to see killings and violence as normal and acceptable," he wrote.
